These Terms and Conditions set out the basis on which Man with Van Marylebone provides removal and related services to private and business customers within the United Kingdom. By placing a booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

1.1 We, us, our refers to Man with Van Marylebone, the provider of removal and associated services.

1.2 You, your, customer refers to the individual or business entering into a contract with us for the provision of services.

1.3 Services means any man and van, removal, collection, delivery, loading, unloading, packing assistance, or related service we agree to provide.

1.4 Goods means all items, effects, furniture, boxes and personal or business property to be moved, transported or handled by us under the contract.

1.5 Booking means a confirmed reservation for services agreed between you and us, including the date, time, locations, resources and pricing.

1.6 Service area refers to the general locality in which we operate, including Marylebone and surrounding districts, together with other locations as agreed.

2. Scope of Services

2.1 We provide man and van and removal services for domestic and commercial customers, including but not limited to collection, loading, transportation and unloading of goods between agreed addresses.

2.2 We may also provide additional services by prior agreement, such as packing or unpacking assistance, disassembly and reassembly of basic furniture, and short-distance internal moves.

2.3 The precise scope of services for each booking will be set out verbally or in writing when you make your reservation. Only services expressly agreed and confirmed form part of the contract.

2.4 We do not undertake specialist removals such as pianos, safes, hazardous materials, or items requiring specialist lifting equipment unless this has been explicitly agreed in advance.

3. Booking Process

3.1 You may request a quotation and make a booking by contacting us through our usual communication channels. You are responsible for providing accurate and complete information regarding the addresses, access details, volume and nature of goods, dates, times and any special requirements.

3.2 Any quotation we provide is based on the information given by you. If that information proves to be incomplete, inaccurate or changes materially, we reserve the right to amend or withdraw the quotation and to adjust the price accordingly.

3.3 A booking is not confirmed until we have expressly accepted your request and provided confirmation. We may refuse any booking at our discretion, particularly where we consider the job unsuitable, unsafe or beyond our available resources.

3.4 It is your responsibility to ensure that the details set out in the booking confirmation are correct. If any information is incorrect or requires amendment, you must notify us as soon as possible and in any event before the service date.

3.5 We may require a deposit or full pre-payment to secure a booking. Any such requirement will be communicated to you during the booking process.

4. Your Responsibilities

4.1 You must ensure that adequate and safe access is available at both collection and delivery addresses, including any parking arrangements required for our vehicle. If parking permits or arrangements are needed, you are responsible for obtaining them unless we have expressly agreed otherwise.

4.2 You are responsible for packing your goods safely and suitably for transport unless we have agreed to provide packing services. Fragile items must be packed appropriately and clearly labelled.

4.3 You must be present or represented by an authorised person at the agreed time to oversee loading and unloading, give instructions, and sign any relevant documentation.

4.4 You warrant that you are the owner of the goods or have full authority from the owner to enter into a contract for their removal and transport.

4.5 You must not ask us to transport any goods that are illegal, hazardous, flammable, explosive, perishable beyond reasonable transit times, or otherwise unsuitable for transport in a standard removal vehicle.

5. Payment Terms

5.1 Unless otherwise agreed, payment is due either in advance or immediately upon completion of the services on the same day.

5.2 We accept payment by the methods advised during the booking process. We do not accept payment by methods not previously agreed.

5.3 Where a deposit is required, this must be paid by the specified deadline. If the deposit is not received, we may cancel the booking without further notice.

5.4 All prices quoted are exclusive of any parking charges, tolls, congestion charges, fines or additional access costs that may be incurred during the job. These will be payable by you in addition to the quoted price, unless stated otherwise.

5.5 For hourly rate bookings, charges will commence from the agreed start time or our arrival at the collection address, whichever is earlier, and will continue until unloading is completed. Waiting time caused by delays outside our control is chargeable at the agreed rate.

5.6 If payment is not made when due, we reserve the right to charge reasonable interest on any overdue sums and to withhold delivery of goods until payment in full has been received.

6. Cancellations and Changes

6.1 If you wish to cancel your booking, you must notify us as soon as possible. The effective date of cancellation is the date on which we receive your notification.

6.2 For cancellations made more than 48 hours before the scheduled start time, any deposit paid may be refundable at our discretion, less any reasonable administrative costs we have incurred.

6.3 For cancellations made within 48 hours of the scheduled start time, we reserve the right to retain part or all of any deposit paid and to charge a cancellation fee up to a reasonable proportion of the agreed price, reflecting the time reserved and any loss of business.

6.4 If you wish to change the date, time, addresses or scope of the services, this will be subject to availability and may result in an adjusted quotation. We are not obliged to accept requested changes, particularly where they would disrupt other scheduled work.

6.5 We may cancel or postpone a booking in circumstances beyond our reasonable control, including but not limited to severe weather, vehicle breakdown, accidents, illness, or other events that make it unsafe or impossible to carry out the work. In such cases we will seek to offer an alternative date or a refund of any pre-paid amount for services not yet provided, but we shall not be liable for any indirect or consequential loss arising from such cancellation.

7. Delays and Access Issues

7.1 We will make reasonable efforts to arrive at the agreed time, but times are estimates only and are not guaranteed. Traffic, road closures and other factors may cause delays.

7.2 If we are delayed, we will attempt to inform you as soon as reasonably possible. We shall not be liable for any indirect or consequential loss resulting from delays beyond our reasonable control.

7.3 If there are delays or waiting times caused by factors within your control, including but not limited to lack of parking, keys not being available, premises not being ready, or your lateness, we reserve the right to charge for waiting time at the agreed hourly rate.

7.4 If we are unable to complete the job due to access restrictions, unsafe conditions, or your failure to be present or represented, we may treat the booking as cancelled by you and charge a reasonable fee reflecting the time and costs incurred.

8. Limitation of Liability

8.1 We will exercise reasonable care and skill in handling and transporting your goods. However, our liability for loss of or damage to goods is limited as set out in this clause.

8.2 We shall not be liable for any loss or damage arising from the following causes:

a. Inadequate or improper packing by you or a third party not instructed by us.

b. Normal wear and tear, scratching, scuffing or minor dents that may occur in the ordinary course of removal work.

c. Fragile or delicate items, including but not limited to glass, china, electronics and artwork, unless we have specifically packed and handled them with knowledge of their nature.

d. Perishable items, cash, jewellery, watches, precious metals, stones, important documents or items of extraordinary value, whether or not these were disclosed to us.

e. Loss or damage arising from your instructions, where such instructions are given against our advice or involve risk.

8.3 Our total liability for any claim arising out of or in connection with a single booking, whether in contract, tort or otherwise, shall be limited to a reasonable sum having regard to the value of the affected goods and the price paid for the services, subject to any applicable mandatory law.

8.4 We shall not be liable for any indirect or consequential losses, including but not limited to loss of profit, loss of income, loss of opportunity, or any losses arising from delays, missed appointments, or similar events.

8.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

9. Claims and Complaints

9.1 You must inspect your goods as soon as reasonably possible after completion of the services. Any apparent loss or damage attributable to our services should be notified to us without undue delay.

9.2 To assist us in investigating any claim, you should provide full details, including photographs where possible, and any supporting evidence requested.

9.3 We will consider all complaints and claims fairly and in good faith. However, failure to notify us within a reasonable period may prejudice our ability to investigate and may affect the outcome of any claim.

10. Waste and Disposal Regulations

10.1 We operate in accordance with applicable UK waste and environmental regulations. We are not a general waste carrier and will not remove or dispose of household refuse or prohibited materials unless this has been specifically agreed and is compliant with relevant laws.

10.2 You must not include in your goods any items classified as hazardous, including but not limited to chemicals, paints, solvents, gas bottles, fuel, asbestos, medical waste or similar substances.

10.3 Where we agree to remove unwanted items for disposal, this will be treated as a separate service and may be charged at a different rate, taking into account weight, volume and disposal costs.

10.4 We will not be responsible for any penalties, fines or costs arising from your failure to comply with waste regulations or for including prohibited items among your goods. You agree to indemnify us against any such liabilities resulting from your actions or omissions.

11. Insurance

11.1 We maintain appropriate insurance cover in relation to our vehicles and our business activities, as required by UK law.

11.2 Our insurance may not cover all types of goods or all potential losses. You are strongly advised to arrange your own additional insurance cover for high-value or particularly fragile items if required.

12. Data Protection and Privacy

12.1 We will collect and process personal data about you for the purposes of managing your booking, providing the services and handling payments, queries and complaints.

12.2 We will take reasonable steps to keep your personal data secure and will not share it with third parties except where necessary for the performance of the contract, compliance with legal obligations, or with your consent.

13. General Provisions

13.1 The contract between you and us is formed when we confirm your booking and is subject to these Terms and Conditions, which constitute the entire agreement between the parties in relation to the services.

13.2 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to your contract.

13.4 You may not assign or transfer your rights or obligations under the contract without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary to perform the services.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the services shall be governed by and construed in accordance with the laws of England and Wales.

14.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
